These Terms of Service govern your use of the Saburi Cargo website and services, including quote requests, shipment coordination, tracking, customer support, and related logistics workflows.
1. Definitions
- Company, we, us, or our means Saburi Cargo.
- Customer, you, or your means any person or entity using the website or services.
- Shipment means any package, cargo, goods, or consignment submitted for coordination, transport, or related handling.
- Services includes quote handling, air freight, sea freight, consolidation, e-commerce delivery, pickup coordination, tracking visibility, and related customer support.
2. Scope of Services
Saburi Cargo provides logistics-related services that may include air freight, sea freight, consolidation, pickup coordination, shipment visibility and tracking support, documentation and customs-related coordination, e-commerce delivery support, and customer portal or account support.
Specific services may vary by shipment, route, destination, regulatory requirements, and operational availability. We may refuse, suspend, or limit service for any shipment or customer where necessary for safety, compliance, operational, legal, or fraud-prevention reasons.
3. Customer Responsibilities
- Provide accurate shipment, contact, and account information.
- Provide correct cargo descriptions, dimensions, values, and destination details.
- Ensure shipments comply with all applicable laws and regulations.
- Cooperate with documentation, customs, and compliance requirements.
- Ensure that any item submitted for shipping is lawful, properly declared, and safe for transport.
Unless otherwise agreed in writing, you are responsible for any duties, taxes, customs charges, storage fees, inspection costs, or destination-related charges imposed by third parties or government authorities.
4. Prohibited and Restricted Items
You may not submit shipments that contain unlawful, prohibited, hazardous, or improperly declared items. These may include firearms, ammunition, explosives, hazardous chemicals, illegal drugs, counterfeit goods, currency, negotiable instruments, or perishable items without proper approval or documentation.
Saburi Cargo may inspect or reject shipments where prohibited or undeclared items are suspected.
5. Quotes and Service Information
Quotes are based on the information available at the time they are prepared. If shipment details change, including weight, size, contents, route, handling requirements, or customs issues, the quote may also change.
Website content, FAQs, tracking displays, service descriptions, and general workflow information are provided for convenience and do not override a specific written quote, shipment confirmation, invoice, or approved service arrangement.
6. Delivery Timing, ETD, and ETA
Any transit timing, ETD, ETA, routing estimate, or service timeline provided by Saburi Cargo is an estimate only unless expressly guaranteed in writing.
Delivery timing may vary due to carrier schedules, flight or vessel changes, customs processing, port congestion, weather, regulatory review, documentation issues, security checks, or other events beyond our control. Saburi Cargo is not liable for delays caused by carriers, customs authorities, government action, force majeure events, or other external conditions.
7. Tracking and Communication
We may provide shipment visibility, tracking references, ETD, ETA, and status updates through the website, customer portal, email, or other communication channels.
Tracking and status information may be delayed, incomplete, estimated, or dependent on carrier or system data. We do not guarantee uninterrupted real-time data availability.
8. Loss, Damage, and Claims
Any claim for loss, shortage, damage, or delivery issue must be submitted promptly and must include appropriate supporting information, which may include shipment reference or tracking number, proof of value, photographs, delivery records, and any other relevant documentation.
Unless a different written agreement or valid insurance coverage applies, Saburi Cargo’s liability is limited to the lesser of actual documented direct loss or USD $100 per shipment.
9. Insurance
Shipments are not automatically insured unless insurance is specifically requested, approved, and paid for where available. If insurance is purchased, coverage is subject to the insurer’s policy terms, conditions, exclusions, claim requirements, and limits.
10. Payments
Unless otherwise agreed in writing, all charges are due as invoiced. Charges may need to be paid before dispatch, release, or delivery. Unpaid amounts may delay processing, dispatch, release, or final delivery.
11. Right to Refuse or Suspend Service
Saburi Cargo may refuse, suspend, cancel, hold, or terminate service where shipment information is inaccurate or incomplete, payment obligations are not met, prohibited items are involved, fraud or unlawful conduct is suspected, customs or carrier requirements are not satisfied, or operational, legal, or safety conditions require it.
12. Website and Portal Use
You agree not to misuse the website, tracking tools, quote tools, FAQ search, portal access, or contact workflows. You must not submit false information, attempt unauthorized access, interfere with security or availability, scrape or automate the service in a harmful way, or use the site for unlawful purposes.
13. Limitation of Liability
To the fullest extent permitted by law, Saburi Cargo is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to shipment delays, customs holds, carrier actions, tracking inaccuracies, missed ETD or ETA estimates, website downtime, lost business, lost profits, or third-party failures.
Nothing in these Terms excludes liability where exclusion is not permitted by applicable law.
14. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles, and where applicable, relevant laws and regulations connected to shipment origin, destination, customs, and transport handling.
15. Changes to These Terms
We may update these Terms from time to time. Updated Terms become effective when posted unless a later date is stated. Continued use of the website or services after an update means you accept the revised Terms.
